Recently, some postpartum care workers in Southern California have complained that it's difficult to find jobs because some maternity centers are recruiting them from mainland China. These Chinese women working as postpartum care workers in the US may be suspected of visa fraud, illegal employment, and other crimes. Local lawyers say that employers who hire these Chinese women may face the same charges as the women they hire, with a maximum sentence of 15 years in prison.
一位在南加地区做月嫂超过十年的中年月嫂抱怨说,现在变得越来越难找工作。这位日前在橙县做月嫂的中年女子认为,找不到工作的原因是一些月子中心在设法从中国大陆招聘年轻女子来美工作,这些人抢了她们的饭碗。据这位不愿具名的中年月嫂所知,这些从中国来的月嫂均是持十年多次往返签证来美的。

A middle-aged postpartum nanny with over ten years of experience in Southern California complained that finding work is becoming increasingly difficult. This woman, currently working as a nanny in Orange County, believes the reason for her joblessness is that some postpartum care centers are recruiting young women from mainland China, who are taking away her jobs. According to this nanny, who wished to remain anonymous, these nannies from China are all on ten-year multiple-entry visas.
She stated that she had traveled extensively throughout Southern California to earn money, working at numerous postpartum care centers. Because of her expertise in postpartum meals and knowledge of traditional Chinese postpartum care methods, finding work was previously easier. However, recently working at a postpartum care center in Irvine, Los Angeles, she said that finding work is no longer as easy as it used to be: some postpartum care centers, including the one she previously worked at, are recruiting nannies from mainland China. These nannies are young, efficient, and hardworking, making it difficult for middle-aged nannies like herself to compete. Some pregnant Chinese women even bring their own nannies from China, and these nannies provide services from the time they are in the US for pregnancy to the time they are in postpartum care.
华裔律师刘龙珠表示,他已注意到月子中心聘用国外月嫂的现象,他的律师事务所也接过几桩本地月嫂与月子中心之间闹劳资纠纷的官司。刘龙珠说,以他的办案经验看,一般月子中心老板都喜欢从中国大陆聘用月嫂,在资方眼里,本地月嫂中中老年者多,体力差、事多,而且熟悉本地环境, 流言蜚语多。而从中国大陆招聘的年轻女子则“心眼少”、体力好,一般不用担心劳资纠纷问题,因为她们没身份,不敢告业主。
刘龙珠表示,这些从中国大陆来美做工的女子,若在来美之前已计划好来美做月嫂,而却用旅游签证入境,则有可能涉嫌签证欺诈,涉嫌联邦重罪,一旦罪名成立,将面临最多15年的牢刑,此外她们还涉嫌在美国非法打工,违反劳工法。刘龙珠说,那些从中国聘用月嫂来美的月子中心老板,则涉嫌与中国月嫂同谋签证欺诈罪,若罪名成立同样面临最高刑期15年的牢刑,而且这些老板非法雇用劳工,涉嫌违反移民法。那些自带保姆来美生产的中国孕妇以及她们的保姆也会面临相同的法律问题。
Chinese-American lawyer Liu Longzhu stated that he has noticed the phenomenon of postpartum care centers hiring foreign nannies, and his law firm has handled several labor disputes between local nannies and these centers. Liu said that based on his experience, postpartum care center owners generally prefer to hire nannies from mainland China. From the employers' perspective, local nannies are often middle-aged or elderly, physically weak, troublesome, and familiar with the local environment, leading to more gossip. Young women hired from mainland China, on the other hand, are considered less cunning, physically strong, and generally don't pose a labor dispute risk because they lack legal status and are hesitant to sue the owners.
Liu stated that if these women from mainland China planned to work as postpartum nannies in the US before coming, but entered on tourist visas, they may be suspected of visa fraud, a federal felony. If convicted, they could face up to 15 years in prison. Furthermore, they may be suspected of working illegally in the US, violating labor laws. Liu Longzhu stated that owners of maternity centers who hire nannies from China to come to the US are suspected of conspiring with these nannies to commit visa fraud, which carries a maximum sentence of 15 years imprisonment if convicted. Furthermore, these owners are illegally employing workers, potentially violating immigration law. Chinese pregnant women who bring their own caregivers to the US for childbirth, along with their caregivers, will also face similar legal issues.
一位曾经投资过月子中心的商人,及一位在生意上每天都要与数量不小的月子中心来往的业者均表示,曾听说过南加州地区有月子中心从中国大陆聘用月嫂, 但并非普遍现象。
A businessman who had invested in a postpartum care center and an operator who deals with a significant number of postpartum care centers daily both said they had heard of postpartum care centers in Southern California hiring postpartum care workers from mainland China, but this was not a common practice.
