• 一年半前由朱姓雇主帮忙申请,从上海来到纽约的金妹,为朱先生担任小孩的保姆,没想到500多个日子不间断的工作,不仅没有领过一分薪水,护照还被雇主扣押。金妹日前向法拉盛社区守望互助队队长朱立创投诉后,终于在28日从雇主手中领到应得的薪水,重获自由的生活。

    Jinmei, who came to New York from Shanghai a year and a half ago with the help of her employer surnamed Zhu, worked as a nanny for Mr. Zhu's child. Unexpectedly, she worked continuously for more than 500 days without receiving a penny of salary, and her passport was even confiscated by her employer. After complaining to Zhu Lichuang, the captain of the Flushing Community Watch Team, Jinmei finally received her due salary from her employer on the 28th and regained her freedom.

    来自上海嘉定的金妹说,她先前在朱先生的姐姐家里工作,帮忙照顾小孩,随后在朱先生家人的询问下,来到纽约帮忙照顾3岁、6岁、和8岁的三个小孩、她居住在雇主家,负责洗衣服、煮饭等家事。金妹说,当初朱先生答应第一年支付她8万人民币,第二年支付10万人民币的薪水,并且会将钱汇到她在中国的老公帐户里,但随着时间过去,却迟迟不见朱先生支付薪水,在询问后,朱先生则以“钱先放在我这里,不会赖帐”的说法,继续拖欠薪资。

    Jinmei, from Jiading, Shanghai, said she previously worked at Mr. Zhu's sister's house, helping to take care of the children. Later, after being asked by Mr. Zhu's family, she came to New York to help care for three children aged 3, 6, and 8. She lived in her employer's house and was responsible for household chores such as laundry and cooking. Jinmei said that Mr. Zhu initially promised to pay her 80,000 RMB in the first year and 100,000 RMB in the second year, and would transfer the money to her husband's account in China. However, as time passed, Mr. Zhu failed to pay her wages. When she inquired, Mr. Zhu continued to delay payment, saying, "The money is with me first; I won't default on it."

    金妹说,在两、三个月前开始和其他保姆聊天的过程中发现,自己的情形相当不合理,不仅薪水比其他保姆低,而且在过去期间根本就没有领过,她在他人介绍下,于26日前往法拉盛社区守望互助队办公室求助,一脸愁容地向队长朱立创表示,她也不冀望拿到薪水,但至少把护照拿回,让她重返自由。

    据了解,这对年约45岁的朱姓夫妻,于华尔街金融界工作,居住于哈德逊河附近,一间价值250万美元的公寓。

    Jinmei said that two or three months ago, while chatting with other nannies, she discovered that her situation was quite unreasonable. Not only was her salary lower than theirs, but she hadn't received any payment at all. On the 26th, through a referral, she went to the Flushing Community Watch and Mutual Aid Team office for help. Looking distressed, she told Team Leader Zhu Lichuang that she didn't expect to get her salary back, but at least she wanted her passport back so she could regain her freedom.

    It is understood that the Zhu couple, both around 45 years old, work in the Wall Street financial sector and live in a $2.5 million apartment near the Hudson River.

    朱立创指出,他随后代替金妹致电给雇主,要求将护照及其薪水归还,并告知他可以开始寻求法律顾问,也以柔性劝说,希望他将心比心,公平对人。雇主一开始虽态度强硬,但最后终知自己理亏,于27日上午将共2万1300元的薪资交还给金妹。

    朱立创表示,许多新移民因为不熟悉法律,害怕争取自己的权益,因而遭受到无故欺压都是不被容许的事,他呼吁类似情形的受害者应该勇敢站出,要求自己被公平的对待。

    Zhu Lichuang stated that he then called the employer on Jinmei's behalf, demanding the return of her passport and salary. He also advised her to seek legal counsel and used gentle persuasion, hoping she would empathize and treat him fairly. Although the employer initially remained firm, he eventually realized his mistake and returned the $21,300 in salary to Jinmei on the morning of the 27th.

    Zhu Lichuang emphasized that many new immigrants, unfamiliar with the law and afraid to fight for their rights, are subjected to unwarranted oppression, which is unacceptable. He urged victims in similar situations to bravely stand up and demand fair treatment.
